Alberta’s Provincial Court of Appeal has ruled 4 to 1 that the federal government’s carbon tax is unconstitutional.
Alberta Premier Jason Kenney says his government disagrees with the idea that a one-size-fits-all consumer tax will reduce emissions.
the appeal also questioned if the federal government could impose a carbon tax on a province, which Kenney believes erases the essential division of powers at the heart of a federal confederation.
This court decision is the first of 3 to vote the tax unconstitutional.
Two previous decisions in Saskatchewan and Ontario ruled the other way.
The Saskatchewan government then applied to the Supreme Court and the hearing is in March.
