Greg Fertuck, charged with the first degree murder of his estranged wife and indignity to a body will hear the judge’s verdict on Friday morning in Saskatoon Court of King’s Bench. Last week, there was a kink in the schedule because Fertuck had asked that the trial be opened up again to hear more evidence and that a mistrial be declared. He told Justice Richard Danyliuk in court on Monday that he didn’t really want to declare a mistrial but did want to present a firearms expert.
Danyliuk’s written decision states that Fertuck believes the gun was to have been underground for six years so it should have had more rust. The Justice noted that the evidence phase is complete and submissions have been made, and he added that Fertuck had a month to bring this forward.
When it comes to the mistrial application, Danyliuk’s written decision states, “There is no basis in fact, in the evidence before me, or in law, to grant any of the relief sought by Mr. Fertuck His application was ill-conceived and without legal foundation and is dismissed in its entirety.” That means the judge’s decision in this case will go ahead as planned on Friday morning in Saskatoon’s Court of King’s Bench.
Sheree Fertuck was 51 years old when she was reported missing in December of 2015. Her body has never been found but her truck and personal belongings were found at the gravel pit she worked at near Kenaston. Greg Fertuck was arrested and charged in 2019 and his trial was originally set to begin in March of 2021, but there have been many delays along the way.
